My Lords, this seems to be a relatively short debate, which has shown evidence of the great knowledge and experience that the noble Lord, Lord McKenzie, has in this field. There was a debate recently on the Child Maintenance and Other Payments Act 2008, which informs a lot of his questions and points. However, I have not heard anything in those arguments that undermines the primary objective of the coalition Government to restore ministerial accountability for child maintenance. ..(more)..

We can learn a lot from countries such as Australia, which has a much more shared parenting approach, uses much more mediation and is generally more successful.

Another of my constituents is a young father who has a valid contact order in place. He previously had full custody of his little girl. He is not in any way dangerous-indeed, he is a devoted dad. He last saw his daughter in July. She cries out when she sees him and her grandmother in the local shopping centre, longing to be with him. He has tried since July to get a court date to see her before Christmas, but that has not been possible. He left my surgery in tears after I had updated him on what the family court service had said about his case.

Another constituent also had a valid contact order and on 21 June, the Monday after fathers' day, he received a text to say that the mother of his child had disappeared, leaving no address. Even after a court seek-and-find procedure, no address was provided. A first court date was set in a court a long way away from where my constituent lives, but it was adjourned. When the case did get into court on 4 October, the proceedings were shambolic, the judge was not well briefed and the appropriate file was not there. The case was adjourned again until 30 November and, on 28 November, the mother succeeded in getting that hearing adjourned, as-allegedly-a medical report on the child was not ready. When my extremely persistent constituent finally got the case into court earlier this month, he found that the medical report was dated 18 November and had been available for the earlier court hearing, but of course there was no sanction on the mother. The courts allow difficult parents to deprive their children of a relationship with their father.

I am proud to be an MP for a Government who are radical and reforming in many ways, and I put it to the House that we need radical reform of the family justice system. We need a system that is much less winner takes all, less confrontational and less expensive; and we need a system that provides proper enforcement of court-sanctioned contact orders

Christmas is a time that parents look forward to celebrating with their children when they can. However, for many parents that is not possible-and I am thinking not only of our troops in Afghanistan, but of the 3 million children in this country who live apart from a parent and, in particular, of those who are caught in the family justice system. I think particularly of non-resident parents who are trying to get access to or have contact time, as it is called, with their children. This issue also affects grandparents, aunts and uncles to a very great degree.

Sadly, it is abundantly clear that the present family justice system is much too slow. Its processes are greatly abused by parents with no penalty or sanctions applied. It is far too expensive in many cases. One of my constituents, a father, came to see me to say that he had spent more than £8,000 obtaining a court-sanctioned contact order to see his children. He did not abuse that order, but it was not honoured and he could not get it upheld by the courts or the police. Unsurprisingly, he was then short of money to pay maintenance as he wanted to do.

The most vivid example of the failure to honour a court order came from a warrant officer who came to see me. He took his civilian overcoat off and underneath he was in uniform. On his chest was his badge of office-a crown, as those who have served in the armed forces will know-and he put the court order on the table in front of me with the crown of the court on it, stipulating that he should have time with his children every other weekend. That court order was not honoured, and it was not upheld by the police or the courts. He felt deeply let down.

Why #wco won’t be putting cartoons on our profiles for the #NSPCC

The wheresmydad.org.uk™ Charitable Organisation was created with the simple vision, philosophy and tagline of “promoting fairness, equality & parity for BOTH parents”.

This is the guiding principle in all of our activities, whether scrutinising parliamentary activity, or building our knowledge systems for our support tool wNat.

This simple statement means we cannot agree to situations where discrimination is present, whether implied or explicit.

Unfortunately this our “sticking point” with the NSPCC.  They have spent £250 Million pounds on advertising it’s recent “Full Stop” campaign, that according to New Philanthropy Capital thought the campaign was “flawed and naive” with “zero evidence” it actually benefitted any children.

In addition to this possible waste of a massive amount of money, the NSPCC has consistently opposed an automatic right of contact for both parents, arguing that this is not necessarily in the best interests of the child.

It is for this reason we will not be putting a cartoon character as our profile pictures on social networks.

With an average full time staff of 1871 people, at £57.8 million on wages & salaries and an additional £7.3 million on pensions (Average NSPCC earnings: £30,894 + £3,882 pension totalling £34,776 per year).
Let us not forget the 31 people that earn more than £60,000 per year (6 over £100,000 per year)

Total Voluntary Income (the money you put into the collecting tins etc) …… £102,074,000
Total Employee Costs (paying the people and pensions etc) …… £71,248,000

Therefore, simple arithmetic shows Employee costs are 69.8% of Donations.  So that for every £1 you donate, nearly 70 pence is for staff, and just over 30 pence goes to their objectives.

Surely there may be a better way to spend all this money?

Comment by #wco: Ratified in Dec 1991, yet we still do not have enforceable children's rights in Family Court.

As stated: In many jurisdictions, properly implementing the Convention requires an overhaul of child custody and guardianship laws, or, at the very least, a creative approach within the existing laws. The Convention acknowledges that every child has certain basic rights, including the right to life, his or her own name and identity, to be raised by his or her parents within a family or cultural grouping, and to have a relationship with both parents, even if they are separated.

Comment by #wco: We would suggest that rather than an inclusive list as Schedule 1, there is an exception list - by default, ALL public funded bodies to be included. In addition, where public bodies create other entities, including commercial partnerships, then these derivative bodies are covered by the Act too. This loophole allows councils to create companies (eg housing association partnerships) that can hide performance, policy and frustrate any scrutiny on their activities.

I am today publishing "Tackling fraud and error in the benefit and tax credits systems" a new joint DWP and HMRC strategy. This will be followed by a wider cross-government approach to tackling fraud, error and debt collection across the rest of the public sector being led by the Minister for the Cabinet Office. This strategy contains proposals to reduce significantly the level of fraud and error in the welfare system. It contains measures to prevent fraud and error from the outset of any claim; root out and correct mistakes where they do happen; deliver tough punishments for those who defraud the system; and deter those who would try to abuse the system in future. ...

"All financial information should be shared between all relevant agencies (both central and local) to eliminate errors and inconsistencies. In addition, this would provide the basis for correct assessment of universal benefit payments in the future.

We would strongly suggest the concept of "Circumstance Payments" that would replace all current benefits. The idea of "Income Based" or "Contribution Based" should disappear, along with "Passport Benefits". Additional help (eg free prescriptions etc) would be granted based on the total household income rather than what type of benefit received."

Shared Parenting Bill

We must bring to your attention the presentation of the Shared Parenting Bill by Mr Brian Binley MP on 13 July 2010.

He was supported in the bill by MP’s Dr Thérèse Coffey, Mr Douglas Carswell, Mr Philip Hollobone, Mr Christopher Chope, Mr Peter Bone, Mark Reckless, Caroline Dinenage, Mark Pritchard, Harriett Baldwin and Mr David Nuttall
Although not confirmed by Mr Binley yet, the draft text indicates that these would be new Court Orders that would need to be applied for, rather than an actual legal presumption of Shared Parenting without the need for confirmation by a judge.
We as an organisation greatly welcome this bill, and hope it gains the support it so justly deserves.

Role of Parental Responsibility

As part of the development process of NAT, our NRP Awareness Tool, we identified lots of areas where Parental Responsibility (PR) is either ignored, misunderstood or just wrongly interpreted.

Various areas of concern exist, including Childcare, Healthcare & Education. Although Central Government agencies understand PR, local government or regional agency offices appear not to.

We will be releasing how we understand PR regulations within England & Wales, with links to existing legislation, practice direction, precedence and published guidance.

The aim is to "de-skill" this area of law, providing clear indications of how the regulations should be implemented and removing and reducing ambiguity of intent.

Brighter website and #NRP Awareness Tool close to release

We’ve spruced up the main website as part of the upcoming release of our #NRP Awareness Tool.  It’s taken a little longer than expected, but it’s all looking good !

“NAT” (NRP Awareness Tool) will allow a parent to generate, follow-up and manage a suite of correspondence with government departments, non-governmental bodies and relevant agencies to highlight and reinforce the position of NRP (Non Resident Parent) where the PwC (Parent with Care) has upset the status quo of regular contact.

Security Warning – Anyone may be able to obtain your email address from Facebook !

Do you have an account with Facebook ?

Have you changed your Privacy Settings for Contact Information ( http://www.facebook.com/settings/?tab=privacy&section=contact ) to stop people getting your email address?

We use a number of providers for email services, to protect our “name”, including Google, Microsoft and Yahoo too …

Unless you have protected your email address within the Privacy Settings on Facebook, anyone importing contacts to Yahoo will get a list of these email addresses into their Yahoo Contacts!

Within Facebook, we have a number of “Friend Lists” setup, including what we call “9 Limited” – most new “friends” are added to this list when we respond to a friend request within Facebook, just until we know who they are.  In the Privacy Settings, we do not allow people to see certain things – like phone numbers and email addresses – by including the “9 Limited” list in the “except:” boxes.

WE STRONGLY RECOMMEND YOU TO CREATE A SIMILAR “LIMITED” FRIENDS LIST, ADD UNKNOWN CONNECTIONS (WHICH INCLUDES FRIENDS, APPLICATIONS AND PAGES) AND CHANGE YOUR PRIVACY SETTINGS TO NOT ALLOW ANYONE TO VIEW YOUR PRIVATE CONTACT INFORMATION e.g. EMAIL ADDRESS OR MOBILE NUMBER.

Once we found this out, we did a small test and found that we could get 90% of email addresses for our friends on Facebook !! We’ve deleted the downloaded contact records.

“You cannot negotiate with these people and expect rational discussion”

Although I appreciate you may not like "the system", and shouting may be good for the short term, the only way we believe to change things is to use the system.  By "use", we mean understand, consider and anticipate the way "it" works. 

This means acting like a solicitor, as you say, LISTENING to what people think is wrong with "the system" and then respond in a meaningful and structured way.

Our stated activity at the moment is assessing the state of UK & EU law.  This is no easy task and is taking time.  However, where we see a distinct area we can make a positive and constructive change, we formulate policy and strategy to overcome these obstacles.

It may sound like "lawyer" or "politician speak" - and that is EXACTLY what we're aiming for.  We want to be able to accurately oppose the current situation and argue the case for NRP's, and we do understand that some other groups do not agree with our methods.  The more fronts that we can make public and loud, the better - but again, these are OUR methods, and we think they will have an impact on the overall situation suffered by Non Resident Parents.

We believe that getting involved in the creation, amendment and repeal of legislation is the best way to improve the situation and increase equality for Non Resident Parents in a currently unfair, unjust and plainly biased system.

Automatically creating and managing your personal mail campaign

We’re developing software to create and manage the "letter writing" process for Non Resident Parents, to reinforce their position prior to the established "status quo" of contact with their children changing. As part of this is the use of the correct language to enable further automatic complaints to be raised when the agencies and authorities fail or refuse to assist - including the use of the Administrative Court and Civil Procedure Rules. In addition to updating our automatic letter generation tool, for Non Resident Parents, we are looking at creating Applications for Permission to Apply for Judicial Review of court and public agency decisions, action or lack of action, of these public agencies.

Version 1 of the tool currently asks for lots of information about your circumstances, and generates specific letters based on your answers, to specific agencies and related parties.  We envisage version 2 will include the correct information in follow up letters that will comply with the Pre Action Protocol.  Where fees are payable, so long as you’ve followed our procedures for Information Collection and Initial Agency Awareness, we anticipate we will provide funding for this, where alternative funding is not available.  A brief description of these procedures can be seen here: http://wheresmydadorguk.giving.officelive.com/currentCampaigns.aspx
