My hon. Friend the Under-Secretary of State responsible for welfare reform, Lord Freud of Eastry, has made the following statement:
We have commissioned the Social Security Advisory Committee to undertake an independent review of passported benefits and how they link with universal credit. Passported benefits include, for example, free school meals, free milk and vitamins, free prescriptions, optical and dental care.
The Committee has been asked to produce an advisory report, taking account of the UK Government's view that changes should not involve a net increase in public expenditure and the benefit system should be as simple as possible. I have placed a copy of the terms of reference in the Library.

(1) what assessment he has made of the effectiveness of the Child Support Agency and its successor in ensuring appropriate maintenance payments are made; and what changes he proposes to make under the reformed statutory child maintenance system;
(2) what steps he is taking to improve the (a) efficiency and (b) effectiveness of the Child Maintenance and Enforcement Commission;
(3) what steps he is taking to ensure that the reformed statutory child maintenance system will provide resident parents with (a) an efficient and (b) a coherent service.
Comment by #wco: £460 million (40% cost to collect) ... a shocking waste of money. If they invested this money in promoting, encouraging and allowing NRP's to see their children then we are sure the maintenance "problem" will be reduced dramatically.
Add onto this the costs for legal aid, judicial costs, capital costs for court buildings and all the other ancilliary costs then this figure will probably exceed £1 billion per year.

We should be including the same level of Parenting Class and care requirements to expecting parents as is afforded to and required by Foster Carers.
Only by education will society understand that having a child is not a passport to a new home or a lifestyle choice. Paragraph 5.35 of the Norgrove interim report
(31/3/11) states that
"In 2010 there were nearly 1000 applications for enforcement orders in respect of contact orders. In the same year, only 55 orders were made. Over the same period, there were 13 applications for financial compensation, with only four orders made."
That of course discounts all the parents who went back to court for a fresh order, or those who couldn't afford £90 and a day in court to apply and lose. With a 0.5% chance of any order being made, who can blame them?

Vital expert witnesses may be too afraid to testify because of the "chilling effect" of a Supreme Court ruling that leaves them open to being sued, lawyers warned yesterday.
The ruling last week removed immunity for expert witnesses, reversing more than 300 years of legal protection. Lawyers predict the change will prompt many lawsuits against experts
Comment by #wco: So some "experts" are worried they will be the target of civil suits against them. If their "expert opinion" is valid, then any amount of scrutiny and examination will uphold their view. If anything, the expert witness's that can prove their opinion will prevail and the justice system become more accurate, predictable and trusted.
The footnote on the familylawweek.co.uk article by James Badenoch QC says "The worry is that expert witnesses will be frightened off by their concerns about being sued. Child protection cases give rise to the greatest concern. Children being maltreated crucially depend on doctors being willing to stand up and give evidence, and this will be another disincentive for those people to be willing to lend their learning."
Why do these people have any concerns? If they have a valid opinion they can surely trust the legal system they make money from?
Step away from the ivory towers people, and smell the coffee ...

The family justice system needs significant reform to tackle delays and ensure that children and families get the service they deserve, says an independent panel set up to review how the system works.
The panel, who publish their interim report today, have recommended a package of proposals aimed at improving children's and families' experience of the system. A public consultation on these proposals is now underway

Ten Minute Rule Bill
On 29 March 2011, Tory MP Charlie Elphicke proposed a bill aiming to require courts and local authorities to take into account the rights of a child to grow up seeing both parents when determining custody arrangements.
The bill would make it an offence for a relevant body to disregard this presumption.
Mr Elphicke argues children who see both parents have better education and employment prospects in later life.

To ask the Minister for the Cabinet Office what steps he plans to take to increase levels of transparency in Government decision-making in order to improve accountability to the public.
Comment by #wco: We like this, however as part of the Big Society, more and more services will be delivered by organisations that are not subject to FOI requests - we suggest the following changes to FOI legislation:
where a civic service or function is provided,
or where a partnership exists where one parter is already subject to FOI then that subsequent provider and partnership is also a "derived" subject to FOI requests
in addition, the preamble to the legislation is to inclusive, rather that prescriptive for organisations to be subject to it. ie, any organisation spending central/local government money is subject to FOI unless specifically time-limited excluded - with scrutiny for the decision.

Local authorities are bound by statute. Their functions are set out in numerous Acts of Parliament and many of these functions have associated legal duties.
The duties on local authorities have accumulated over the years with successive pieces of legislation. While some duties remain vital, others may no longer be needed or may create unnecessary burdens or restrictions on local authorities. To address this, the Government is carrying out a wide ranging review to establish the duties which are no longer needed and to remove them, giving local authorities freedom to operate in a way that meets local needs and priorities.

Comment by #wco: So the government are state "we will implement a cap of three crisis loan awards for general living expenses in a rolling 12-month period." - So when claims are messed up by the civil servants (and I've had personal experience of being destitute for over 8 weeks and having to have at least 3 crisis loans as a direct result of administration errors) then claimants may suffer more distress and homelessness as Housing Allowance is not paid while there is this situation.
THIS IS A VERY BAD SET OF NEW REGULATIONS !

That this House believes that children are entitled to the love, guidance and support of both parents and a relationship with their wider family after separation and divorce unless certain restrictions apply, to ensure children can enjoy the benefits this gives; further believes in the desirability of creating a legal presumption of shared parenting orders if necessary, meaning parents are equally responsible for their children and those children spend a significant proportion of their time with each parent; and calls on the Government to recognise this need for a presumption of shared parenting in the family justice review.

You know it makes sense ... Remember that at an election, if a ward has 10,000 eligible voters in it, with a 45% (and that's relatively high!) turnout that means only 4,500 people actually vote .. if the MP is voted in with 40% (again relatively high!) of that turnout it means only 18% (1,800) of the people are effectively controlling the other 82% (8,200) !! Not exactly majority rule is it ???
